GenBroll provides users with an AI-powered platform to generate professional B-Roll video content from text prompts, images, or reference videos. Our service utilizes advanced AI models to create high-quality video footage suitable for various content creation purposes.

Use of the Service

You agree to use GenBroll in accordance with all applicable local, state, national, and international laws and regulations. The service is provided for legitimate content creation purposes only.

User Accounts and Registration

Account Creation: To access video generation features, you need to create an account. You must provide accurate and complete information during the registration process.
Age Requirement: You must be at least 13 years old to use GenBroll. If you are under 18, you must have parental or guardian consent.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Content and Intellectual Property Rights

Generated Content Ownership

Generated Videos:
- Free Plan: Generated videos may include a watermark and are for personal use only.
- Paid Plans: Generated videos are provided without watermarks and include a commercial use license as specified in your subscription tier.
- Pro Plan: Includes full commercial rights to all generated videos.

Platform Intellectual Property

GenBroll Platform: All technology, code, infrastructure, and AI models that power GenBroll are proprietary and owned by GenBroll (genbroll.com).
Restrictions: You may not:
- Reverse engineer or attempt to extract the source code of our platform
- Redistribute or resell access to GenBroll
- Use GenBroll to create a competing service

AI Model Attribution

Videos are generated using third-party AI services (including but not limited to Sora, Kling, Runway). You acknowledge that:

These AI providers may have their own terms of use
Generated content is unique but may occasionally resemble other AI-generated content
GenBroll is not responsible for similarities between generated videos

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

Content Restrictions

Generating videos containing illegal content
Creating content that infringes on others' intellectual property rights
Producing deepfakes or misleading content without proper disclosure
Generating explicit, violent, or harmful content
Creating content that promotes hate speech or discrimination

Service Abuse

Attempting to bypass credit limits or payment requirements
Using automated systems to generate content at scale beyond your subscription limits
Interfering with or disrupting the service's security or performance
Attempting to gain unauthorized access to our systems or other users' accounts
Reselling credits or generated videos without authorization

Violation of these terms may result in immediate account suspension or termination.

Credits and Billing

Credit System

Credits: Each video generation consumes a specified number of credits based on:
- Generation type (text-to-video, image-to-video, video-to-video)
- Video duration
- AI model selected
- Resolution settings
Credit Expiration: Monthly credits expire at the end of each billing cycle and do not roll over
Credit Purchases: One-time credit purchases do not expire

Pricing and Payments

Subscription Plans: We offer Free, Creator, and Pro subscription tiers
Payment Terms: Subscriptions are billed monthly or annually based on your selection
Price Changes: We reserve the right to change pricing with 30 days notice to existing subscribers
Failed Payments: If a payment fails, your account may be suspended until payment is resolved
Taxes: Prices may not include applicable taxes, which you are responsible for

Refund Policy

Subscription Refunds: No refunds for partial months. You can cancel anytime and retain access until the end of your billing period.
Credit Refunds: Credits are non-refundable except in cases of service failure
Failed Generations: If a video generation fails due to our system error, the credit will be automatically refunded
Disputed Charges: Contact support@genbroll.com within 30 days of a charge if you believe it was made in error

Service Availability and Limitations

Service Level

GenBroll is provided on an "as is" and "as available" basis
We strive for 99.9% uptime but do not guarantee uninterrupted service
Scheduled maintenance will be announced in advance when possible
Generation times may vary based on system load and complexity

Generation Limitations

Video quality and accuracy depend on prompt quality and AI model capabilities
We do not guarantee specific results from any prompt
Some prompts may be rejected if they violate our content policies
Generation may fail due to technical limitations or AI service unavailability

Privacy and Data Collection

GenBroll collects the following types of data:

Account Information: Name, email, and profile details
Generation Data: Prompts, uploaded files, and generated videos

Termination

By You

Limitation of Liability

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or other intangible losses
Damages arising from your use or inability to use the service
Damages resulting from unauthorized access to your account
Damages from errors or omissions in generated content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO GENBROLL IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless GenBroll, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

Content Responsibility and License Grant

Your Responsibility

You are solely responsible for:

The prompts and content you submit to GenBroll
Ensuring you have rights to any images or videos you upload
How you use the generated videos
Compliance with applicable laws when using generated content
Proper disclosure when using AI-generated content (where required by law or platform policies)

License to GenBroll

By using the service, you grant GenBroll a limited license to:

Process your prompts and uploaded content to generate videos
Store your generated videos temporarily on our servers
Use aggregated, anonymized data to improve our AI services
Display your generated content as examples (only with your explicit permission)

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GenBroll operates, without regard to its conflict of law provisions.

Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at support@genbroll.com to attempt to resolve the dispute informally.
Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration rather than in court.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions.
Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or violations of these Terms.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective:
